CONDITIONS OF SALE
These General Conditions govern the use of the online store for which Bernard Rives Escultor (hereinafter, "Bernard Rives") is legally responsible. By accepting these Terms, the User declares that they have read, understood, and comprehended the above and that they assume all obligations thereof. If the User does not agree with the content of this document, they must leave this website and may not access or use the services offered. Furthermore, the User expressly and without exception accepts that access to and use of this website, its services, and its content are under their sole and exclusive responsibility.
These Terms and Conditions may be modified at any time and without prior notice. Users are responsible for reviewing them at the time of purchase. The terms and conditions in effect at the time of purchase will be the ones that apply.
Applicable regulations
This electronic contract is governed by Spanish law and, in particular, by:
- Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSICE).
- Law 3/2014, of March 27, General for the Defense of Consumers and Users (LGDCU).
The electronic contract will not be archived by a third party. It is written in Spanish (unless the website offers options for other languages). These Terms of Sale may be saved and reproduced at any time by the User making a purchase, using the options in their internet browser. They must be accepted before proceeding with payment for the order.
User account and error correction
To make purchases in the Bernard Rives online store, the User can:
- Register and create an account, or
- Buy as a guest without registering.
2.1. Purchase as a guest
If the User chooses to purchase as a guest, their personal data will be used exclusively to manage and deliver the purchased products. It will not be stored in a permanent account, and therefore, they will not be able to view their order history later.
2.2. Account Registration
If the User decides to register, they will receive a confirmation email with their login information. Through their account, they can:
- Make purchases more agile.
- Check your order and invoice history.
- Modify personal information, delivery and billing addresses.
- Carry out other procedures related to your purchases.
Additionally, you may access your private account at any time to check and correct any errors entered. Users may unsubscribe at any time by sending an email from the email address with which they registered to contact . This will result in the deletion of their personal data in accordance with the Privacy Policy.
Purchase process
Making a purchase in Bernard Rives' online store is very simple:
- Product Selection : Access the product information sheet (sculpture or other piece of art) you wish to purchase. You'll find a detailed description, key features, images, price, and applicable taxes.
- Add to cart : Once you have selected the product, click the “Add to cart” button.
- Order Summary : After completing your selection, a summary will be displayed with the selected items and their total amount (including, where applicable, taxes and shipping costs, if applicable).
- Place Order : To continue, click the “Place Order” button.
- Payment method : Choose one of the available payment methods (see section 4).
- Confirmation : You will receive an email with your purchase details and the invoice or proof of payment. If you do not receive this email within 24 hours or if you discover any errors, please contact us via contact .
If you would like a paper invoice, please let us know and we will send it to you at no additional cost.
Payment methods
At Bernard Rives we offer several secure payment options:
- Credit or debit card
Payment is made through a secure gateway. Bernard Rives does not receive or store the User's card information. The transaction is carried out directly with the bank, guaranteeing the confidentiality of the information. - PayPal
If you choose PayPal, Bernard Rives also doesn't manage your bank details; the entire process is done on the PayPal platform.
- Klarna
possibility of splitting payments into 3 interest-free installments.
Deliveries
5.1. Delivery areas
We offer shipping to:
- Spain (Peninsula and Islands).
- Countries of the European Union.
- Other international destinations (check availability).
Delivery is carried out through trusted courier companies. Unless otherwise indicated, shipping costs will be indicated during the purchase process or will be free if advertised on the website.
DUA and import taxes
For shipments to destinations with customs requirements (Canary Islands, Ceuta, Melilla, or other countries outside the EU), Bernard Rives is not responsible for the Customs Duties (DUA), import fees, or taxes (IGIC, ISPI, tariffs, etc.). These costs are always the buyer's responsibility.
5.2. Delivery times
The estimated delivery time will be indicated during the purchase process. If there is any delay attributable to us, the User may grant us additional time. If delivery is still not possible within the additional time, the User may terminate the contract, in which case the full amount paid will be refunded.
For products on backorder or subject to handcrafting (for example, custom sculptures or limited series), the User will be informed of the approximate delivery time. If there are substantial changes, the User will be contacted to offer alternatives or the option to cancel the order.
Force majeure : We are not responsible for delays due to causes beyond our control (natural disasters, strikes, conflicts, etc.). In the event of an incident, we will contact the User to find the best solution.
Prices, taxes, tariffs and fees
Prices are expressed in euros. Any price changes will not affect orders for which a shipping confirmation has already been sent.
- Spain (Peninsula and Balearic Islands) : The price includes applicable VAT.
- European Union (private buyer) : The price includes VAT of the country of origin (Spain).
- European Union (company/professional with VIES) : The price will not include VAT if the buyer provides a valid intra-community VAT ID number.
- Canary Islands, Ceuta, Melilla, or countries outside the EU : The price does not include VAT. The customer will be responsible for any applicable import taxes and duties at destination.
If an error is detected in the price of a product, we reserve the right to cancel the order and refund the amount paid.
Account and service cancellation, cancellation and blocking
7.1. Voluntary withdrawal
Users may request the deletion of their account at any time by sending a request to our contact email address. This process entails the deletion of their data in accordance with our Privacy Policy.
7.2. Non-payment
In the event of non-payment for an order, it may be suspended until the order is resolved. If the non-payment continues for more than 15 days, Bernard Rives may cancel the order.
7.3. Misuse
Bernard Rives reserves the right to block or delete a User account (without prejudice to the obligation to pay for pending orders) if it detects improper, fraudulent, or uncompliant use of the account. In such cases, the User will be notified by email or phone.
Returns
At Bernard Rives, we want to ensure your satisfaction. Therefore, we offer various return options if the product doesn't meet your expectations.
A. Incorrect, defective or damaged product in transit
- If you receive the wrong item or one with a manufacturing defect, please contact us immediately to resolve the issue.
- If the damage occurred during transport, please note it on the carrier's delivery note if possible and notify us immediately.
Products must be returned properly protected. Bernard Rives can arrange collection at no cost. If the User chooses a different carrier and the cost is higher, the difference will be borne by the User.
B. Right of withdrawal
Individual buyers have 14 calendar days from receipt of their order to return it if it does not meet their expectations, in accordance with consumer legislation.
To exercise this right, please send your return request to our email [contact email].
- The product must be in perfect condition, preferably with its original packaging and all accessories.
- The refund will be made using the same payment method used for the purchase, within 14 calendar days following receipt of the product or confirmation of the return.
- Return shipping costs will be borne by the buyer.
Exceptions :
Returns will not be accepted for products that, for reasons of hygiene or health protection, are unsuitable for return if they have been unsealed, nor for digital products that have been enjoyed or downloaded.
C. Cancellation before delivery
If the order has not yet been processed or shipped, it can be canceled at no additional cost by informing us as soon as possible.

Guarantees
Bernard Rives' works and sculptures are handcrafted, so slight variations in color, texture, or finish may exist compared to the photographs on the website. These differences do not diminish the quality of the piece or constitute a defect, but rather confirm its unique and original character.
However, all products are covered by the legal warranty of 3 years against manufacturing defects, in accordance with current regulations regarding consumers and users (or 1 year in the case of non-new or refurbished products, if specified).
If the product presents a lack of conformity within the first two years of delivery, the defect is presumed to be of original origin. Bernard Rives will repair or replace the product free of charge, or issue a partial or full refund, as appropriate.
This warranty does not cover damage due to misuse, drops, impacts, exposure to unsuitable conditions, tampering, or unauthorized repairs.
